TEMPORARY STAY AND WORK PERMIT ‍

To stay and work in Poland for more than 3 months You may obtain a unitary permit – a temporary stay and work permit

Note❗️
There are 2 types of “work” under the Polish legal regulation in a field of issue of this permit:

I. A temporary stay permit to perform work in a profession requiring high qualifications
II. A temporary stay and work permit

The first type is granted to those aliens, who possessing the skills certified by higher professional qualifications, who, regardless of the legal relationship between the parties, performs work to the benefit of or under the supervision of another person for a salary.

In this case “Higher professional qualifications” – are qualifications obtained as a result of completing a higher education program or at least five years of professional experience on the level comparable to the level of qualifications obtained as a result of completing a higher education program, necessary to perform the work specified in the contract.
Besides the applicant has to enter into an employment contract for at least 1 year and perform work or provide services based on this contract.

The second type of permit, is granted if the circumstances that justify the alien’s stay and work on the territory of the Republic of Poland for a period longer than 3 months and do not undermine possessing by the alien skills certified by higher professional qualifications.

Important ❗️❗️
To what groups of foreigners this permit may not be applied:

  • ▶️ residing within the territory of Poland for the purpose of tourism or visit of family or friends and hold a visa issued by another country of the Schengen area or a visa issued by Polish body with the same purpose
  • ▶️ employees delegated by an employer seated outside borders of the Republic of Poland;
  • ▶️ conducting economic activities in Poland;
  • ▶️ performing seasonal work in Poland;
  • ▶️ residing within the territory of Poland on the basis of obligations as stipulated in international agreements concerning facilitation of entry and temporary residence of certain categories of natural persons, dealing with commercial transactions or investments.
