The latest case from my practice involved a foreigner’s application for international protection in Poland (hereafter referred to as IP). This foreigner was unknown to me before (I was involved in the procedure on behalf of the state authority). During the submission of the application, it was discovered that this person had been misled by “lawyers” who claimed that obtaining international protection in Poland required a specific fee and that only a lawyer could secure a positive decision.
THIS IS NOT TRUE! The foreigner was deceived!
Obtaining IP is completely free!
What does the legislation say about the conditions for obtaining IP in Poland? “… the applicant should have a well-founded fear of persecution in the country of origin on account of race, religion, nationality, political beliefs, or membership in a particular social group, and cannot avail themselves of the protection of that country. The applicant must be able to provide proof…”
Who is involved in the procedure: the applicant (providing proof of the need for IP); the State Border Guard; the Office for Foreigners’ Affairs. No lawyers! No intermediaries!
In other words, you (the applicant for IP) must be able to substantiate your concerns as mentioned above.
The procedure step-by-step includes:
– Calling the nearest facility of the State Border Guard.
– Booking an appointment to submit an application for IP.
– Submitting the application.
– Possible contact from the Chief of the Foreigners’ Affairs Office for an additional interview/conversation.
The State Border Guard (the competent state authority for submitting an application) can even provide an interpreter for the applicant.
So, to the point: considering the information mentioned above:
– Do you need someone’s help to prove a real danger to Your life and health in your country of origin? NO.
– Can’t you book a visit to the State Border Guard facility by Yourself? YES, YOU CAN.
– Are there any obligatory expenses/fees? NO FEES.
Expenses: for transportation to the state authority and Your photo.
DON’T ALLOW YOURSELF TO BE MISLED!
Regarding my services: I provide explanations related to the procedure and assistance during visits to the State Border Guard, if necessary. There is no place for payable services at the phase of submitting an application up to the final decision by the Chief of the Foreigners’ Affairs Office.
Once more: A foreigner applying for IP in Poland does not need to seek out a lawyer or intermediary; you can manage it by yourself!
In conclusion: unethical lawyers and unprincipled intermediaries, do not mislead people – it is a sign of professional weakness. Stop being professionally incompetent!
